AXIS GROUP STORE REGULATIONS
§ 1 General provisions
1. The Platform and the Store's owner at: www.axisgroup.pl is: Axis Group Sp. z o. o, located at Węglewo 8a, 62-010 Pobiedziska, phone: +48 530 309 241,

2. The terms used in the Regulations mean:
(a) Store - online store www.axisgroup.pl.
(b) Platform - an Internet platform available at the electronic address www.axisgroup.pl
(c) Customer - an entity that purchases Goods or Services from the Store.
(d) Consumer - a natural person who performs a legal transaction with the entrepreneur unrelated to his business or professional activity.
(e) Entrepreneur - a natural person, legal person, or an organizational unit that is not a legal person, to which legal capacity is granted by a separate act - conducting business or professional activity on its behalf.
(f) Entrepreneur with consumer rights - a natural person concluding a contract with the owner of the Store as part of the subject of the Store's activity, directly related to its business activity, but not having a professional nature for that person, resulting in particular from the subject of its business activity, made available based on the provisions on the Central Register and Information on Economic Activity.
(g) Registration - Customer’s activity consisting of providing personal data and accepting the terms necessary to create an Account.
(h) Seller - Axis Group Sp. z o. o, Węglewo 8a, 62-010 Pobiedziska
(i) Account - an individual account on the Platform, access to which is possible after registration and logging in by the Customer, in which information (data) about the Customer is collected, enabling the use of the Platform's functions.
(j) Goods - goods offered by the Store.
(k) Working days - all days of the week from Monday to Friday, excluding public holidays.
(l) Price - the unit price of the Good or Service included in the description of the Good or Service, expressed in Polish zlotys and including VAT.
(m) Total Price - the total price, taking into account the number of Products or Services ordered, including delivery costs and additional costs (if any).
(n) Proof of purchase - a VAT invoice or other proof of Product purchase.
(o) Regulations - these Store regulations specify the rules for using the Platform and are the regulations referred to in Art. 8 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws 2016.1030).
(p) Personal Data - information about an identified or identifiable natural person within the meaning of Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR).
3. The subject of the Platform and Store's activity is the online sale of Goods offered by the Online Store and the provision of Services by electronic means in the form of Account and Newsletter.
4. The sale is made via the Internet in the form of a distance contract between the Customer placing the order and the Store.
5. All Goods offered in the axisgroup.pl store are brand new, originally packaged, free from physical and legal defects, and have been legally placed on the Polish market.
6. The Customer may access the Regulations at any time via the Platform, download them and print them out.
7. The Customer is obligated to use the Platform in a manner consistent with the provisions of the Law in force in the territory of the Republic of Poland, the provisions of the Regulations, and the general principles of using the Internet. Therefore, it is forbidden both in relation to the Platform and the Store:
(a) to provide untrue, illegal, or misleading content,
(b) to undertake behaviors that may cause disruptions, damage to ICT systems, or violation of system resources,
(c) to use bots, crawlers, and other tools that automate access or affect the operation of the Platform or the Store without the consent of the Service Provider
(d) to use it contrary to their intended use.
8. Correct use of the Store is possible, provided that the IT system used by the Customer meets the following minimum technical requirements:
(a) a device with access to the Internet,
(b) an active e-mail account operated by the Customer.
§ 2 Orders
1. The prices of the Goods are given in Polish zlotys and include all components, including VAT, customs duties, and all other components. Prices do not include delivery costs.
2. An order may be placed using the form on the website around the clock, on any day of the week, except for periods when the Platform is not available.
3. The choice of Goods ordered by the Customer is made by adding them to the cart.
4. The Customer may purchase Goods and Services in the Store after prior registration on the website or without registration.
5. The Buyer is asked to read and accept the Regulations before placing an order.
6. The Customer is responsible for the correct and complete provision of data in the registration form or the sales form without registration. The Customer is obligated to update the provided data on an ongoing basis.
7. After the Customer using the Store has provided all the necessary data, a summary of the order will be displayed. The order summary contains information on the subject of the order, unit, and total price of the ordered products or services, including delivery costs and additional costs (if any), and the selected payment method.
8. Confirmation of placing and accepting the order for processing will be sent to the Customer in an e-mail. Thus, the sales contract is considered concluded
9. The following payment methods are valid in the Store:
(a) fast PayU payment;
(b) card payment;
(c) prepayment by traditional bank transfer;
10. The following delivery methods are used in the Store:
(a) Courier shipment using DPD
(b) Pallet courier shipment using the DHL carrier
11. In the transfer title, please provide the data that allows you to assign the payment to the order specified by the Store.
12. The order is shipped immediately after its completion. The order is completed after the payment is credited to the Seller's bank account specified in the order confirmation in the case of payment by bank transfer or at the moment of placing the order in the case of payment by card or selecting the "cash on delivery" option.
13. The order execution takes up to 7 working days (usually the second working day).
14. Failure to record the payment within 14 days from the date of order confirmation, despite the call for payment, results in the cancellation of the order.
15. According to the Customer's choice, the sale made in the Store is documented with a fiscal receipt or a VAT invoice. The Customer authorizes the Seller to issue a VAT invoice without the recipient's signature and an invoice as an electronic document. The VAT invoice will be sent to the Customer at the email address provided by the Customer or as otherwise agreed with the Customer.
§ 3 Complaints
1. The Store is obligated to deliver Goods free from defects.
2. The Customer may file complaints relating to the purchased Goods.
3. Customers who are Consumers or Entrepreneurs with consumer rights have the right to submit a complaint if the sold Goods have a physical or legal defect (Warranty). A physical defect consists of the non-compliance of the sold item (Goods) with the contract.
4. A complaint may be filed:
(a) in the case of Customers who are Consumers or Entrepreneurs with consumer rights - on the dates and the terms specified in the provisions of art. 556-576 of the Civil Code - to the extent that these provisions apply to the warranty when selling to Consumers;
(b) in the case of Customers who are not Consumers or Entrepreneurs with consumer rights - within two days from the date of receipt of the Goods in the scope of the quantitative complaint and within 14 days from the date of receipt of the Goods - in the scope of the quality complaint.
5. It is recommended to attach photos of the Goods being subject to the complaint to the complaint to accelerate its recognition. If it turns out to be necessary for the proper consideration of the complaint, the Customer is obligated to send the defective Goods to the Store's address.
6. The Store will consider the complaint as soon as possible - not exceeding, in any case, 14 days from its receipt. The Store will immediately notify the claimant about the result via e-mail or a letter sent by post.
§ 4 Right of withdrawal
1. A Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the sales contract without giving reasons by means of a written statement submitted within 14 days.
2. To meet this deadline, it is enough to send a statement before the end of the 14-days. The declaration of withdrawal from the contract may be formulated by the Customer, using the template constituting Annex 2 to the Consumer Rights Act or in another documentary form containing an unambiguous statement by the Customer.
3. The Seller shall immediately, but not later than within 14 days from the date of receipt of the items back or delivery by the Customer who is a Consumer or Entrepreneur with the rights of a consumer of proof of its return, depending on which event occurs first, will return to him all payments made by him, including the costs of delivering the Goods. The Seller shall refund the payment using the same payment method as used by the Customer, who is a Consumer or an Entrepreneur with consumer rights.
4. In the event of withdrawal from a distance contract or a contract concluded outside the business premises, the sales contract shall be deemed not to be concluded. In this case, the Customer, who is a Consumer or an Entrepreneur with consumer rights, will return the Goods.
§ 5 GDPR
1. In connection with creating an account in the Store, the newsletter service, and the conclusion of a sales contract regarding the Products, the Seller is the administrator of the personal data provided by the Customer.
2. The Customer's data will be processed to perform the concluded contract (its conclusion, fulfillment and payment) and to fulfill the Seller's legal obligations, as well as for marketing purposes, after the Customer's voluntary consent in this regard.
3. The Seller collects the following customer data:
(a) in the case of creating an Account: name, surname, individual login, e-mail address,
(b) in the case of concluding a sales contract: name, surname, and address of residence, possibly depending on the individual choices of the Customer: bank account number, other data related to the payment, and shipping address.
(c) in the case of a newsletter: The Customer's e-mail address
4. The Customer's data will be processed by:
(a) the period of the Customer having an account in the Store - in the scope of data provided when creating the account,
(b) the period of limitation of claims arising from the contract for the sale of Goods, unless the Law requires the Seller to process them longer - in the scope of data provided in connection with the sale of the Goods,
(c) until the consent to marketing activities and the newsletter is withdrawn - in the scope of data provided for marketing purposes and the e-mail address in connection with the newsletter.
5. The Customer's data may be made available to entities providing the Seller with services related to running the Store (accounting, IT support, hosting, e-mail, CRM providers) and the delivery (carriers and postal operators).
6. In connection with processing the Customer's personal data, the Customer has the right to request access to the content of his data - within the limits of art. 15 GDPR, its rectification - within the limits of art. 16 GDPR, removal - within the limits of art. 17 GDPR, processing restrictions - within the limits of art. 18 GDPR, data portability - within the limits of art. 20 GDPR, object to the processing of personal data - within the limits of art. 21 GDPR, and the right to complain to the supervisory authority if the processing of personal data violates the provisions.
§ 6 Cookies
1. The Store uses text files, commonly referred to as cookies, necessary for the website's technical operation and the offered functionalities. Cookies are not used in the Store to track user navigation. In addition, there are no cookies from other entities in the Store, e.g., companies within the behavioral advertising industry.
2. The Store uses cookies only to create anonymous statistics. You can manage cookies through your browser settings.
3. The forms available in the Store use cookies to ensure its functionality and save information about completing a given form.
§ 7 Account and newsletter
1. The Seller provides the Account service free of charge, enabling access to data related to orders in the Store and the newsletter service to send commercial and marketing information via e-mail. Through the newsletter, the Seller informs about the latest products or promotions. The Customer may subscribe to the newsletter by completing the appropriate form on the Platform and agreeing to receive it.
2. The Customer may at any time delete the account or unsubscribe.
§ 8 Final provisions
1. All photos of the Goods and other materials (including texts, graphics, logos) posted on the Platform are the Seller's property or have been used by the Seller with the consent of third parties who own the copyrights to them. It is forbidden to copy photos and other graphic materials and reprint texts posted on the Platform, including their sharing on the Internet, without the written consent by the Seller or other third party having the copyrights.
2. The Regulations are governed by Polish Law.
3. The Regulations are amended by publishing a new version of the Regulations on the Platform.
4. The court competent to hear any disputes arising from implementing the provisions of the Regulations shall be the court designated for the location of AXIS Group Sp. z o. o., unless a different jurisdiction results from the provisions of law.
5. In matters not covered by these regulations, the provisions of the Civil Code and relevant acts shall apply accordingly.
6. The provisions of these Regulations are not intended to exclude or limit any rights of the Customer who is also a Consumer or grant him consumer rights within the meaning of the Act of April 23, 1964 - Civil Code (Journal of Laws of 2014, item 121 with d.), he/she is entitled to under the mandatory provisions of law. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.
7. The Regulations come into force on 30/05/2022
